I don't think we should view the problem from the First Amendment point of view - it will be rather hard and cumbersome to come up with something useful this way.

Much simpler approach is to just allow users of any platform to self-govern in a transparent, consistent way, i.e. bring democracy to those platforms.

Anyway, we do need to have this discussion and it's nice to see legal arguments being put forward.
